Teacake

The UK Treasury is facing a £3.5m bill because of VAT wrongly imposed on a Marks and Spencer teacake, the European Court of Justice (ECJ) has ruled.

Customers paid VAT for 20 years before the authorities accepted the product [wrongly classed as a biscuit] was a cake, which does not command VAT. [BBC]

Will M&S be returning the VAT to its customers?

Exactly. How does the consumer benefit from this? Also, were Tunnock's or other teacake brands for some reason classified differently? Perplexing stuff, the biscuit cake industry.

This reminds me of the Jaffa Cake case from a couple of years ago:

This still doesn't solve the Wagon Wheel conundrum: a wagon-based wheel snack or a wheel-based wagon snack?

M&S need to run a free prize draw for a packet of these things, you know, for interested parties. Nom nom nom.
